Terms of Service

1. Agreement to Terms

By accessing or using BenchSlap PRO ("Service"), operated by BenchSlap LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and BenchSlap LLC. Your continued use of the Service following any changes constitutes acceptance of the updated Terms.

2. Description of Service

BenchSlap PRO is a legal document and strategy platform offering:

• Consigliere: Legal strategy assistant with citation verification
• Drafter: Legal document generation, correction, and citation verification
• Auditor: Document analysis with strength/weakness reports

The Service includes citation verification optimized for Utah state law, with access to federal case law for qualifying tiers.

3. No Legal Advice; No Attorney-Client Relationship

3.1 Not a Substitute for Legal Counsel

BenchSlap PRO is designed as a legal drafting and strategy tool. It is NOT a substitute for advice from a licensed attorney. You should:

• Consult with a licensed attorney in your jurisdiction before taking any legal action
• Independently verify all citations, case law, and legal conclusions
• Not rely solely on BenchSlap output for legal decisions

3.2 No Attorney-Client Privilege

Communications through BenchSlap are NOT protected by attorney-client privilege. While we implement encryption and security measures, your data is processed by our systems and may be reviewed for quality assurance.

3.3 Service Limitations

BenchSlap's analytical tools may produce incorrect, incomplete, or fabricated information. You MUST:

• Read and validate ALL BenchSlap output before using it
• Verify all case citations through official court records
• Not submit BenchSlap output to courts without attorney review

4. User Accounts and Eligibility

4.1 Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

4.2 Age Requirement

You must be at least 18 years old to use the Service.

4.3 Pro Se Certification

Users subscribing to the "Pro Se Pro" or "Pro Se Plus" tier must certify that they are NOT licensed attorneys in any jurisdiction. These tiers are exclusively for self-represented litigants. False certification may result in:

• Immediate account suspension
• Mandatory upgrade to Attorney Pro tier pricing
• Potential legal action for fraud

4.4 Attorney Verification

Attorney Pro, Litigator Elite, and Enterprise tier subscribers who are licensed attorneys must provide valid Utah State Bar numbers for verification. We verify bar status through official Utah State Bar and Utah Courts records.

5.2 Billing Terms

• All fees are non-refundable except as required by law
• Subscriptions automatically renew unless cancelled
• Unused monthly allocations do not roll over
• Price changes effective upon renewal with 30 days notice

5.2 iOS/Mobile Subscriptions

Due to platform restrictions, subscription management on iOS devices must be completed through benchslap.pro in a web browser. In-app purchases are not available on iOS.

6. Acceptable Use Policy

6.1 Permitted Uses

• Legal strategy and document preparation for personal cases (Pro Se users)
• Legal strategy and drafting for client matters (Attorney users)
• Educational purposes and legal study
• Document preparation assistance

6.2 Prohibited Uses

You may NOT use the Service to:

• Practice law without a license (unauthorized practice of law)
• Represent yourself as an attorney when you are not
• Submit BenchSlap output as your own work without disclosure where required by court rules
• Generate documents for illegal purposes
• Harass, defame, or harm others
• Circumvent usage limits or access controls
• Reverse engineer, decompile, or disassemble the Service
• Share account credentials or resell access

6.3 Prohibited Automated Access & Computer Fraud and Abuse Act Notice

Without limiting the foregoing, the following are unauthorized access and constitute a material breach of these Terms:

• Scraping, crawling, harvesting, or bulk-extracting any content, citations, opinions, rules, search results, user-interface text, or other output of the Service by any automated means (including bots, headless browsers, scrapers, distributed crawlers, or commercial dataset compilers).
• Ingesting, indexing, distilling, embedding, or otherwise using any portion of the Service — including source code, documentation, whitepapers, API responses, generated documents, or interface text — as training data, fine-tuning data, retrieval-augmented-generation corpus, evaluation set, or benchmark for any machine-learning model, neural network, large language model, or AI system, whether commercial or non-commercial. This prohibition is independent of any robots.txt directive and binds operators of public-web crawlers (Common Crawl and similar), commercial dataset compilers, and AI-model developers (including OpenAI, Anthropic, Google, Meta, Microsoft, Amazon, xAI, DeepSeek, Mistral, Cohere, Stability AI, and any successor or affiliate).
• Reverse engineering the Service's algorithms, data structures, prompts, weights, or verification architecture, including by black-box probing or output analysis intended to reconstruct internal logic.
• Bypassing or attempting to bypass rate limits, authentication, captchas, paywalls, IP blocks, user-agent restrictions, robots.txt, or any other technical access measure.
• Republishing, mirroring, or redistributing the Service's compiled corpus, ranked rankings, structured fact store (AEGIS PRIME), or content-hash registry (AEGIS) in any form.

Any model whose training or fine-tuning data knowingly or unknowingly incorporates Service content is a derivative work under 17 U.S.C. § 106(2). Operators are on constructive notice as of the effective date of these Terms and the public deposit of our defensive-publication artifacts at /legal/ip-defense.html.

BenchSlap reserves all remedies under the Computer Fraud and Abuse Act, the Defend Trade Secrets Act of 2016 (18 U.S.C. § 1836), the Copyright Act, applicable state computer-misuse and trade-secret statutes, and these Terms — including injunctive relief, attorney's fees, statutory damages, and disgorgement of profits.

7. Intellectual Property

7.1 Our Property

The Service, including without limitation its software, verification systems (AEGIS™, AEGIS PRIME™, the V4 Advocacy Algorithm™, Citation Gravity™, Chomper™, Commission Inquest™, Vox Omnium™), templates, prompts, fact stores, corpus compilation, ranking formulas, branding, trade dress, and all derivative outputs, is owned by Richard L. Sanders / BenchSlap LLC. Provisional and non-provisional patent applications have been or will be filed with the United States Patent and Trademark Office covering these inventions. BENCHSLAP™, BENCH SLAP PRO™, BENCH SLAP BASIC™, 4ALL.HELP™, OPTION.BLACK™, AEGIS™, AEGIS PRIME™, CITATION GRAVITY™, CHOMPER™, COMMISSION INQUEST™, and VOX OMNIUM™ are common-law trademarks of the rights holder, with USPTO TEAS Plus applications filed or pending. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose only.

7.2 Your Content

You retain ownership of documents you upload. By uploading, you grant us a limited license to process, store, and analyze your content solely to provide the Service.

7.3 Service Output

Content produced by BenchSlap is provided for your use, but you acknowledge it may incorporate public legal information. You are responsible for ensuring any use complies with applicable laws and court rules.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Key points:

• Documents are encrypted at rest (AES-256) and in transit (TLS 1.3)
• Your data is never sold or used for third-party model training — enterprise-grade data processing agreements are in place
• Inactive-account data erasure (effective 2026-05-03): If you do not log in for 30 consecutive days, you will receive a single warning email at the 25-day mark. If you do not log in within 5 days of that warning, your case data, documents, encryption keys, advisor sessions, and silos are permanently and non-recoverably erased. Your login record (username, email, phone) is retained for anti-abuse purposes only. Upon explicit account deletion, the same erasure applies. This is structural — there is no "no warning, no purge" exception, and there is no undo.
• Relegation tier: BenchSlap maintains a relegation subscription tier that may be applied when an account is demoted by administrative action (e.g., terms violation, billing failure, or as an alternative to full erasure). A relegated account remains active for read access — you can log in and retrieve your existing case files and documents — but cannot invoke any AI tool, create new silos, or upload new documents. Restoration to a higher tier requires support contact.
• Original uploaded documents are extracted to text and destroyed immediately — only encrypted text is retained
• We may disclose data as required by law or court order

9. Disclaimer of Warranties

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability is limited to the greater of: (a) amounts paid by you in the 6 months preceding the claim, or (b) $100
• We are NOT liable for indirect, incidental, consequential, or punitive damages
• We are NOT liable for any legal outcomes, court decisions, or sanctions resulting from use of the Service
• We are NOT liable for hallucinations, citation errors, or incorrect legal analysis

11. Indemnification

You agree to indemnify and hold harmless BenchSlap LLC, its officers, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any law or third-party rights
• Content you upload or generate

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles.

12.2 Arbitration

Any disputes shall be resolved through binding arbitration administered by JAMS in Salt Lake City, Utah. You waive any right to participate in class actions.

12.3 Exceptions

Either party may seek injunctive relief in state or federal courts in Utah for intellectual property violations or unauthorized access.

13. Termination

We may suspend or terminate your account for:

• Violation of these Terms
• Suspected fraud or misrepresentation
• Non-payment of fees
• At our discretion with 30 days notice

Upon termination, your right to use the Service ceases immediately. We may retain data as required by law.

14. Modifications

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
